Plain language, because you should be able to read this in the truck. These terms cover working with Nieves Mathews, a sole proprietor in Azusa, California.

What you’re buying

Smart Website + lead system. $1,500 to build, then $299/month. The build covers your website. The monthly covers the missed-call text-back system, the booking calendar, the follow-up automations, hosting, and small changes while you’re on it. The first month is included in the build fee.

Smart Website, one time. $1,999. The website only, built and handed to you. It does not include the text-back system, which runs on paid software and carrier messaging that cost money every month to operate.

Missed Call Rescue. $500 setup, then $299/month. The text-back system wired onto the phone number you already have.

What you own

Your domain, your website, the code, your phone number, and your customer list are yours. Not licensed to you. Yours. If you stop working with me you take all of it, and I’ll help you move it.

The one exception is third-party software I use to run things, like the messaging platform. I can’t give you ownership of somebody else’s product, but I can transfer your account and your data out of it.

Cancelling

Month to month. No annual contract and no auto-renew trap. Tell me you’re done and the monthly stops at the end of that billing period. I don’t hold your site or your number hostage on the way out.

The response-time guarantee

While you’re on a monthly plan, the system will send an automatic text back on every missed call in under 60 seconds. I’ll give you the delivery log with timestamps so you can check it yourself.

If the system stops firing and I can’t fix it, that month is free. What happens after the message leaves my hands is not something I control, so I won’t promise it: carrier outages, a phone that’s off, a number that blocks texts, or a customer who doesn’t reply. I also can’t promise you a number of jobs. That depends on how many people call you.

What I need from you

Photos, your license number, your service area, and answers to a few questions. Two-week builds assume you get me that in the first few days. If it takes three weeks to get photos, it takes three weeks longer.

You’re responsible for the accuracy of what you give me: license numbers, certifications, insurance claims, service areas, and anything else that goes on the site as fact.

Text messaging rules

If I set up messaging for your business, you agree to use it lawfully. That means you only text people who contacted you or agreed to be contacted, you honor STOP requests, and you don’t use the system for mass marketing to purchased lists. Carriers and the TCPA both take this seriously, and violations can get your number shut off. If you use the system that way, I’ll stop working with you.

Payment

Build fees are due before the site goes live. Monthly fees bill on the same date each month. If a monthly payment is more than 15 days late I may pause the automations until it’s current. Your site stays up.

Limits

I build and run this carefully, but no website or automation is guaranteed to be uninterrupted or error-free. Where the law allows, my liability for any claim is limited to what you paid me in the previous three months.

Governing law

These terms are governed by the laws of the State of California, and any dispute belongs in the courts of Los Angeles County.

Changes

If I update these terms I’ll change the date at the top. If you’re an active client and something material changes, I’ll tell you directly rather than expecting you to check this page.
